F-1 to R-1 Visa
Client C came to us seeking assistance with changing her immigration status from an F-1 student visa to an R-1 religious worker visa. Having been in the United States for over a decade, she had previously also held an I visa as a foreign media representative.
Her case was far from straightforward; USCIS issued a Request for Evidence (RFE), raising complex questions about her eligibility and the bona fides of the petitioning organization.
Our legal team took a proactive approach, conducting an in-depth review of her maintenance of status history, her current role, and the petitioning organization’s compliance record. We worked closely with the client and the organization to gather strong supporting documentation. We prepared a meticulously crafted legal brief addressing every point raised by USCIS. We supplemented the filing with substantial evidentiary exhibits to leave no ambiguity about her eligibility.
Thanks to our team’s diligence, persistence, and strategic case presentation, USCIS approved Client C’s change of status to R-1 without further complications, allowing her to continue her important work in the U.S. without interruption.
H1-B Visa
Client P had filed an H-1B petition after maxing out on their initial 6 years. We filed the H-1B with their approved I-140 and received an RFE in September, 5 months after filing. We worked to submit an exhaustive response. Within two weeks of filing the response, Client P was approved for their new H-1B.
I-360
Client E is in the U.S. on R status for several years. At the two year anniversary, they applied for the I-360 to become a Special Immigrant Worker. After many months, their Special Immigrant Worker status was approved.
Green Card
Mr. L applied for a replacement green card in late March and was approved within a month. This came after a five year absence from the US when his permanent residence was questioned and he was placed in removal proceedings. We accompanied him to court and the judge ruled that the green card was considered valid. As a precautionary measure, we also filed I-130 and I-485 for him. His I-130 was approved and his green card was considered valid.
