EB-2 PERM  |  Market Analyst

Our client, an e-commerce company, has had a long-term partnership with Anderson's team for handling H1B work visas and EB2/3 immigrant green cards involving foreign employees. Upon receiving the assignment, we initiated an EB2 petition for one of the client's foreign employees, who held a market analyst position. Working closely with the client, our attorney team conducted meticulous legal research, drafted the petition documents, and filed a prevailing wage determination application with the U.S. Department of Labor, which was successfully approved. Following that, our team guided the client through advertising the job, organizing hiring documentation, and filing the Labor Certification/PERM application with the DOL based on this groundwork. Naturalization   

E, a permanent resident for 5 years, sought our assistance in applying for naturalization. A day prior to her scheduled interview, USCIS informed her not to appear due to an issue with her physical file not reaching the Field Office. After confirming this information, E refrained from attending. USCIS then issued a Notice of Failure to Appear. We aided E in responding to the Notice and contacted USCIS multiple times until she was reinstated for an interview. After waiting over a year, E finally secured an interview, which we attended with her. That very afternoon, USCIS notified us of her upcoming oath ceremony.

S started on an H-1B in October 2022. Shortly after, his employer, an online retailer, initiated his Green Card process. His PWD was determined after about 9 months, and his PERM was certified nearly 11 months after filing. We prepared his I-140, and the employer opted for premium processing. Just 2 weeks after submission, USCIS approved the I-140.

VAWA Self-Petition

H-1B EOS-RFE  |  Software Developer

L is a Software Developer filing their third H-1B petition. According to current American Competitiveness and Workforce Improvement Act (ACWIA) regulations, an employer isn't required to pay the fee if they previously obtained an extension for the same individual. L's second H-1B petition was filed when they changed employers. This extension requested both an amendment and an extension, including an ACWIA fee. The third extension also included an ACWIA fee, which USCIS initially returned. However, they issued an RFE asking for that fee. Our firm responded to the RFE, requesting clarification on the application of the regulation, and L's H-1B extension was successfully approved.

Asylum Removal Defense

Ms. T became our client through a pro bono program. When we took on the case, she and her son were both in an expedited removal process. We represented them in the master calendar and individual calendar hearings, gathering documents from multiple parties such as social workers, physicians, church members, and family and friends. We prepared them for potential questions from DHS and prepared their witnesses as well. After months of efforts, we were able to get her asylum case approved. Now, Ms. T will have protected legal status in the U.S., and her son will be able to adjust his status too. Additionally, we assisted her in obtaining work authorization and social security numbers.

X was laid off from his H-1B employer and had 90 days to look for a new employer. X's son, who is his H-4 dependent, is attending school in the U.S. We assisted him by filing a new H-4 petition based on X's spouse's H-1B, ensuring his son would not have any gap in his status if X was not able to maintain his H-1B. The petition was approved swiftly, allowing X's son to continue his education without interruption.

F-1 Reinstatement  

Ms. S lost her F-1 status and came to us for help reinstating. We worked diligently to gather her documents (I-20 for Reinstatement and others) and helped her prepare a personal statement and a detailed letter of support related to the reasons for the lapse and her eligibility for reinstatment. She was enrolled in a new school, and had the requisite documents to get approved. We filed in November 2021, and she was approved in July 2022.

Professor N works at a Biblical university in California. He has been on an H-1B since 2016. We successfully filed his first extension in 2019. In July 2022, we filed his second extension, since he had an approved I-140. It took a while for USCIS to process this case as he had a concurrent I-485 pending. However, this August, we got the good news that his extension had been approved, and that the approval notice was on its way.

G's spouse is an H-1B holder with an approved I-140, waiting for his priority date. As such, his wife G is eligible for an Employment Authorization Document (EAD). She got her initial EAD in 2021. She was due for renewal this year, and we filed in June 2023. In late August, her EAD was approved. Thankfully, she may continue to work.

Marriage Green Card & Naturalization

Our client, Mr. M (who is from Taiwan), had his naturalization oath ceremony in early August. He started at one New York firm on an H-1B as a Law Clerk, and then progressed to Associate after he passed the bar. Later, he got married to a U.S. citizen. He retained our firm to assist him in filing application of his marriage Green Card, which was promptly approved. The two year conditional Green Card coincided with his eligibility to file for naturalization. We continued assisting him and filed the naturalization application. Both petitions were approved at about the same time, in a short period.

Mr. S was a long-time H-1B holder who worked as a Music Director in Missouri. He started the Green Card process in 2021. The PWD was determined, and the PERM was certified without an audit. We were able to file the I-140 and the I-485 together because the priority date was current for his country of origin. They received their EAD first, which would have allowed them to travel. The Green Cards came right after, without an interview. Both he and his wife are now lawful permanent residents.

H-1B RFE  |  Systems Analyst

Mr. Y works for a electronic sales company as a System Analyst on his H-1B visa. He has been on H-1B status for over five years and is seeking an extension of his H-1B status before the six year max-out date. He received a RFE, where the USCIS asked him to provide proof of maintanence of his H-1B status. This case is complex becuase Y did not have a well-kept records from five years ago, many documents are hard to locate due to the passing of time. However, we communicated diligently with Y and asked him to locate useful information in lieu of extensive documents. We carfully studied the RFE letter and addressed each concern raised by the USCIS, with the limited information we were able to gather, we build a compelling and extensive response. The RFE was approved within 5 days.

R-1 and I-360 NOID  |  Pastor

Mr. L works as a Pastor for a religious organization with various locations. After filing an R-1 amendment for a change in work location, and an I-360 for special immigrant status, Mr. L received an RFE, and then a NOID, for both applications. USCIS cited to a telephonic compliance review that resulted in discrepancies. We found that USCIS had conducted a single site visit at one of the three locations of the organization, without providing notice or properly communicating their expectations to our firm or the petitioner, after the visit. Both Mr. L and his employer were not at the location for the visit because of this lack of notice. In response, we provided several documents evidencing the organization's activities in each location while also addressing the problems with the current site visit process. We submitted the I-360 NOID response first, and as we were preparing the R-1 NOID response - before we even submitted it, we received an approval notice for both petitions based off the single I-360 response.

R-1 RFE  |  Assistant of Director of Education

Z works as an Assistant of Director of Education for a religious organization. Z received a RFE to her R visa application, where the USCIS raised questions about compensation. We prepared a list of documents, including the organization's bank statement, other employees' W-2s and pay stubs, organizational chart, etc. We communicated efficiently with the client and put together a compelling response letter for Z to prove the employer not only has the ability to pay, but also has been providing consistent compensations to other employees working in similar positions as Z. The RFE was approved shortly after we submitted the response and Z can begin working for the organization.

R-1 RFE  |  Chinese Director of Spiritual Care

Mr. F is a student currently pursuing his Master of Divinity in the US. He has over 5 years of ministry experience and was ordained as a pastor in 2015. However, he still received an RFE from USCIS when he applied for an R visa for the position of “Chinese Director of Spiritual Care” in a church. USCIS requested the petitioner to provide more evidence regarding the nature of this position, whether it is a religious occupation or a minister position. Because it was really urgent for Mr. F, we communicated with the client diligently, researched a lot of cases in the database, prepared the evidence zealously, and eventually put together a coherent and compelling response letter for Mr. F in a short period of time. The following day after the USCIS received the response letter, we received the approval notice for his R visa.

Client Y applied for a change of status from F1 to R2 in July 2022. Y was a student in a Christian University, and is now applying for the R-2 based on her partner's R-1 visa. She received a RFE for maintenance of her F1 status, USCIS asked to prove that Y was properly maintaining her student status. We prepared her response to the USCIS, and the R-2 was approved within 8 days.

H-1B RFE  |  Administrative Assistant

Ms. H was working as an Administrative Assistant with the Petitioner on a valid F-1 OPT status when she applied for H-1B visa. She received an RFE from USCIS requesting evidence pertaining to Ms. H’s maintenance of F-1 student status, showing how working as an Administrative Assistant is directly related to Ms. H’s major area of study, Ministry. We gathered the Volunteer Agreement and some other documents which specified the job duties related to her major. We also searched for the SEVP Policy Guidance and finally demonstrated that working as Administrative Assistant is directly related to Ms. Yin’s major area of study, Ministry. We received the approval notice from USCIS in one week.

F-1 Approval  |  Foreign Correspondant

G was a South Korean national working in the U.S. as a foreign correspondent. She wanted to switch to studying in the U.S. and needed help transferring to an F-1 visa. Her application was filed in January 2022. The student office changed her status to F-1 before the application was approved, and this new I-20 triggered a Request for Evidence. We worked with the applicant and the student office to issue a correct I-20 and submitted this along with other evidence to show that she had not prematurely changed her status. In February 2023, her application was approved.

In the spring of 2022, his employer, our Client, changed his work location, which necessitated an amendment to the original filing. We worked closely with the employer, a Missouri based online retail business that focuses on beauty, personal care, and health products, and D. to swiftly prepare the petition and get it filed with USCIS. This process took only 3 weeks from start to finish. Now, 8 months later, USCIS has rendered its decision and approved the amendment. D. is now in his amended work location.

M was selected in the FY 2023 lottery. She applied for H-1B for herself and H-4 for her son, since her husband was still in the midst of his studies. She was approved in August 2022 and her son was approved in October. In early 2023, her husband concluded his studies, and the family applied for an H-4 for him. That case is still pending with USCIS.

O-1 visa Approval  |  Artist and Associate Professor

G was an accomplished artist in his native China, with many awards and distinguished showings in galleries and other spaces. A prominent US university sponsored his O visa to serve as both a professor and an artist in residence. His petition was very extensive and included copies of his portfolio and a letter of recommendation from an artist's foundation.
