H-1B Amendment  |  Associate Attorney

C was employed as a law clerk at a law firm. However, after successfully passing the bar exam and being admitted in New York, C sought to change her job title to Associate Attorney. We carefully prepared her H-1B amendment petition. After meticulously drafting petition letters and preparing documents, her H-1B amendment petition was approved within two months.

In our response, we included Q's work schedule, performance reviews, Form W-2, Tax Return, and Pay Stubs to demonstrate her compliance with immigration regulations. Additionally, we provided a thorough explanation of the nature and details of both Q's previous and current employment. The petition was approved approximately three weeks after the response was submitted.

We closely collaborated with the beneficiary and the employer to accurately document the employment periods and legal status spanning the 8 years from 2015 to 2023 in the petition packet. Z's petition was filed and approved successfully within 3 months.

H-1B EOS-RFE  |  Software Developer

L is a Software Developer filing their third H-1B petition. According to current American Competitiveness and Workforce Improvement Act (ACWIA) regulations, an employer isn't required to pay the fee if they previously obtained an extension for the same individual. L's second H-1B petition was filed when they changed employers. This extension requested both an amendment and an extension, including an ACWIA fee. The third extension also included an ACWIA fee, which USCIS initially returned. However, they issued an RFE asking for that fee. Our firm responded to the RFE, requesting clarification on the application of the regulation, and L's H-1B extension was successfully approved.

X's son, who is his H-4 dependent, is attending school in the U.S. We assisted him by filing a new H-4 petition based on X's spouse's H-1B, ensuring his son would not have any gap in his status if X was not able to maintain his H-1B. The petition was approved swiftly, allowing X's son to continue his education without interruption.

H-1B Extension (Over 6 years)  |  Professor

Professor N works at a Biblical university in California. He has been on an H-1B since 2016. We successfully filed his first extension in 2019. In July 2022, we filed his second extension, since he had an approved I-140. It took a while for USCIS to process this case as he had a concurrent I-485 pending. However, this August, we got the good news that his extension had been approved, and that the approval notice was on its way.

H4's EAD

G's spouse is an H-1B holder with an approved I-140, waiting for his priority date. As such, his wife G is eligible for an Employment Authorization Document (EAD). She got her initial EAD in 2021. She was due for renewal this year, and we filed in June 2023. In late August, her EAD was approved. Thankfully, she may continue to work.

H-1B Cap Exempt RFE  |  PE & Enrichment Teacher

Mr. A works as a PE and Enrichment teacher at a K-12 private school, and he submitted a cap-exempt H-1B petition. The USCIS issued a RFE concerning the school's cap-exempt eligibility. We gathered documents, reviewed the memorudom of agreement between the school and higher education institutions, and replied to the RFE thouroughly and timely. The USCIS approved the petition within 2 weeks after the submission of the response.

Mrs.K works as an Assistant Professor at an institution of higher education. We prepared her initial H-1B three years ago, and assisted with her H-1B extension. With a well-prepared petition, the USCIS approved this H-1B cap-exempt extension petition and the Client can continue to work at the institution for an additional three years.

J works as an assistant professor in a religious university. He is eligible for a further three-year extension beyond the six-year limitation based on American Competitiveness in the 21st Century Act (“AC21”), which allows a beneficiary of a H-1B visa to extend their status beyond the 6-year limit. J has an approved I-140 and based on his approved I-140, we helped him request an extension of his H-1B status for another three years. The H1B extension petition was approved soon.

J's employer sponsored his H-1B petition as a Computer Systems Analyst and he was selected in the regular CAP. J earned a Bachelor's degree in Computer Science in China, but he does not have a related U.S. degree. After carful preparation, drafting, and reviewing, we submitted J's H-1B petition in May and received a quick approval.

Mr. Z was selected in the FY24 H01B lottery, and wanted to start working for an e-commerce company specializing in the sale of health-related products with a degree in nursing. After learning Mr. Z's work would be providing suggestions on how best to design and enhance your health-related products in the company, we carefully tailored his job duties, and determined that Health Informatics Specialist was the appropriate job title for Mr. Z. Eventally, his H-1B was smoothly approved.

H-1B RFE  |  Systems Analyst

Mr. Y works for a electronic sales company as a System Analyst on his H-1B visa. He has been on H-1B status for over five years and is seeking an extension of his H-1B status before the six year max-out date. He received a RFE, where the USCIS asked him to provide proof of maintanence of his H-1B status. This case is complex becuase Y did not have a well-kept records from five years ago, many documents are hard to locate due to the passing of time. However, we communicated diligently with Y and asked him to locate useful information in lieu of extensive documents. We carfully studied the RFE letter and addressed each concern raised by the USCIS, with the limited information we were able to gather, we build a compelling and extensive response. The RFE was approved within 5 days.

H-1B RFE  |  Administrative Assistant

Ms. H was working as an Administrative Assistant with the Petitioner on a valid F-1 OPT status when she applied for H-1B visa. She received an RFE from USCIS requesting evidence pertaining to Ms. H’s maintenance of F-1 student status, showing how working as an Administrative Assistant is directly related to Ms. H’s major area of study, Ministry. We gathered the Volunteer Agreement and some other documents which specified the job duties related to her major. We also searched for the SEVP Policy Guidance and finally demonstrated that working as Administrative Assistant is directly related to Ms. Yin’s major area of study, Ministry. We received the approval notice from USCIS in one week.

H-1B1 Approval  |  Communications Specialist

F is a Chilean national working in New York City on OPT for a large nonprofit. We worked with him and his employer to prepare the petition to extend his work authorization beyond the end of the OPT. We filed in late December, and by the end of January his H1-B1 had been approved to start later this spring.

H-1B EAD Card Replacement

G never received his EAD card. It was lost in transit between USCIS and USPS. While G already had an H-1B approval and did not need the EAD card anymore, the card was important to have for his future Green Card application. We submitted detailed documentation related to the missing card, along with our joint efforts to track it down. USCIS approved the replacement card in less than a month.

S recently got her H-4 approved. Her husband got his H-1B in 2020, while S continued her studies on F-1 until mid 2022. This summer we helped put together her H-4 application. In 6 short months, USCIS approved this application and S now has a new status, H-4.

J.’s initial Cap Exempt H-1B was approved on January 4, 2023 in time for her to start work for 3 years. Her husband H-4 application was approved on January 11, 2023. We worked closely with the employer, a nonprofit education entity affiliated with a Christian University, and J. to swiftly prepare the petition and get it filed with USCIS. This process took 2 months from start to finish. With Premium Processing, it only took 7 days and 14 days for USCIS render its decision and approve her initial H1B petition and her husband’s H4 petition respectively.

Z and her husband have been on H-1B and H-4 since 2017 wth 2 different employers. The most recent is a media company. Their extensions were filed in June 2022 and approved in December 2022. The couple was able to recapture some time when they traveled back to their native China. They are now approved until December 2024.

D. was selected in the H-1B lottery for the 2022 fiscal year. His initial H-1B was approved in time for him to start work in October 2021. In the spring of 2022, his employer, our Client, changed his work location, which necessitated an amendment to the original filing. We worked closely with the employer, a Missouri based online retail business that focuses on beauty, personal care, and health products, and D. to swiftly prepare the petition and get it filed with USCIS. This process took only 3 weeks from start to finish. Now, 8 months later, USCIS has rendered its decision and approved the amendment. D. is now in his amended work location.

M was selected in the FY 2023 lottery. She applied for H-1B for herself and H-4 for her son, since her husband was still in the midst of his studies. She was approved in August 2022 and her son was approved in October. In early 2023, her husband concluded his studies, and the family applied for an H-4 for him. That case is still pending with USCIS.
